Judicial Interpleader Actions

Judicial interpleader actions arise when a person or company holds money but cannot safely determine who is legally entitled to receive it. Rather than risk paying the wrong person, the stakeholder deposits the money into the registry of a Virginia circuit court and asks the court to determine who should receive it.

These cases frequently involve competing ownership claims, unknown heirs, creditors, lienholders, title disputes, probate issues, assignments, or other questions regarding legal entitlement.

What Must Be Proven?

Obtaining the release of interpleaded funds often requires more than simply asking the court for payment.

Depending on the circumstances, documentary evidence may be required to establish ownership, heirship, lien priority, assignments, probate authority, or other legal interests in the funds. In many cases, the court must also determine that no other person has a superior claim before ordering the money released.
